These Terms of Service ("Terms") govern your use of the By Leonniè website and fashion illustration services. By accessing our website at www.byleonnie.com or engaging our services, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the service.

Our Services

By Leonniè - The Sketch Room provides custom fashion illustration services, including:

• Custom fashion design illustrations
• Bridal wear sketches and designs
• African traditional attire illustrations
• Evening gown and cocktail dress designs
• Everyday elegance and professional wear concepts
• Fashion consultation services
• Collaborative design projects

Project Process and Timeline

Consultation Phase

All projects begin with a consultation to discuss your vision, requirements, timeline, and budget. This consultation may be conducted via video call, phone, or email as mutually agreed upon.

Design Process

• Initial concept sketches based on consultation
• Client review and feedback period
• Revisions (up to 3 rounds included in standard pricing)
• Final illustration delivery in agreed format

Timelines

Standard project timelines range from 1-8 weeks depending on complexity and scope. Rush orders may be accommodated for an additional fee. Specific timelines will be agreed upon during the consultation phase.

Payment Terms and Pricing

Payment Structure

• Deposit: 50% deposit required to begin work
• Final Payment: Remaining 50% due upon project completion
• Rush Orders: Additional 25-50% fee for expedited timelines
• Additional Revisions: Beyond 3 rounds, charged at hourly rate

Payment Methods

We accept payments via bank transfer, PayPal, and major credit cards. All payments are processed securely through third-party payment providers.

Refund Policy

Deposits are non-refundable once work has commenced. Final payments are due regardless of client satisfaction, provided deliverables meet the agreed specifications. Refunds may be considered on a case-by-case basis for exceptional circumstances.

Intellectual Property Rights

Client Rights

Upon full payment, clients receive rights to use the custom illustrations for their intended purpose (personal use, manufacturing, etc.). This includes the right to create garments based on the designs.

By Leonniè Rights

• Right to showcase work in portfolio and marketing materials
• Right to share process photos and final designs on social media
• Copyright ownership of the artistic work and creative process
• Right to create derivative works for educational or promotional purposes

Restrictions

Clients may not resell, redistribute, or license the illustrations to third parties without written permission. Commercial reproduction rights require separate licensing agreements.

Client Responsibilities

To ensure successful project completion, clients are responsible for:

• Providing clear, detailed project requirements and inspiration materials
• Responding to communications and providing feedback within agreed timeframes
• Making payments according to the agreed schedule
• Providing accurate measurements and technical specifications when required
• Communicating any changes or concerns promptly
• Respecting intellectual property and usage rights

Revisions and Project Changes

Included Revisions

Each project includes up to 3 rounds of revisions during the design process. Revisions must be requested within 7 days of receiving each design iteration.

Additional Revisions

Additional revisions beyond the included rounds will be charged at our hourly rate. Major scope changes may require a new project agreement.

Project Scope Changes

Significant changes to project scope, timeline, or deliverables may result in additional charges and timeline adjustments. All changes must be agreed upon in writing.

Cancellation and Termination

Client Cancellation

Clients may cancel projects at any time, but deposits are non-refundable. If work has progressed beyond the initial consultation phase, additional charges may apply for work completed.

By Leonniè Cancellation

We reserve the right to terminate projects due to non-payment, breach of terms, or if the project requirements fall outside our service scope. In such cases, a prorated refund may be provided.

Liability and Warranties

Service Warranty

We warrant that our services will be performed with professional skill and care. However, fashion design is subjective, and we cannot guarantee client satisfaction with creative decisions.

Limitation of Liability

Our liability is limited to the total amount paid for services. We are not responsible for:

• Manufacturing errors or issues with garment construction
• Delays caused by client non-responsiveness
• Third-party services or materials
• Loss of business or consequential damages

Confidentiality and Privacy

We respect client privacy and maintain confidentiality of all project details, personal information, and proprietary designs. However, we reserve the right to showcase completed work in our portfolio unless specifically requested otherwise.

For high-profile clients or sensitive projects, separate non-disclosure agreements may be executed upon request.

Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, or government regulations. In such cases, timelines may be extended accordingly.

Dispute Resolution

We encourage open communication to resolve any issues. In the event of a dispute:

1. Parties will first attempt to resolve the matter through direct negotiation
2. If unsuccessful, mediation may be pursued through a mutually agreed mediator

Website Use and Content
